Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MistyMC Network (the "Service"), including the website at mistymc.xyz, the Minecraft server at play.mistymc.xyz, and the official Discord server. By accessing or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or guardian. By using the Service you represent that you meet these requirements.

2. Your Minecraft account

The Service requires a valid, paid Minecraft Java Edition account. You're responsible for keeping your credentials secure. We are not responsible for actions taken under your account by anyone with access to it.

3. Acceptable use

You agree not to:

• Use cheats, hacks, x-rays, auto-clickers, ESPs, or unauthorized modifications.
• Harass, threaten, or otherwise harm any user.
• Spam, advertise other servers, or solicit users.
• Exploit bugs or duplication glitches. Report them at #bugs on Discord.
• Attempt to access systems or accounts that don't belong to you.
• Disrupt the Service or interfere with its normal operation.
• Resell, transfer, or trade in-game items, currency, or accounts for real-world money.

4. User content

Builds, chat messages, screenshots, and other content you create on MistyMC ("User Content") remain yours. By posting it on the Service, you grant MistyMC a non-exclusive, worldwide, royalty-free license to host, display, and use it for the purpose of operating and promoting the Service.

You're responsible for your User Content. Don't post anything illegal, infringing, harmful, or offensive.

5. Purchases and virtual items

You may purchase ranks, cosmetics, and other items from our store at mistymc.tebex.io. Purchases are subject to our Refund Policy. Virtual items have no real-world cash value, are non-transferable, and may be revoked if you violate these Terms.

We comply with the Minecraft EULA. Items sold do not provide gameplay advantages over non-paying players. See EULA Compliance.

6. Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. You may stop using the Service at any time.

7. Disclaimer of warranties

The Service is provided "as is" and "as available." We make no warranties, express or implied, about uptime, fitness for a particular purpose, or freedom from errors. Your use of the Service is at your own risk.

8. Limitation of liability

To the fullest extent permitted by law, MistyMC, its operators, staff, and contributors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or virtual items, arising from your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless MistyMC and its operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

10. Changes to these Terms

We may update these Terms from time to time. The "Effective" date above shows when the current version took effect. Material changes will be announced in #announcements on Discord. Your continued use of the Service after changes take effect constitutes acceptance.

11. Governing law and disputes

These Terms are governed by the laws of the operator's jurisdiction. Any disputes will be resolved through good-faith negotiation first. If unresolved within 60 days, disputes will be submitted to binding arbitration where permitted by law.

12. Trademarks

Minecraft is a trademark of Mojang AB. MistyMC is not affiliated with, endorsed by, or sponsored by Mojang AB or Microsoft.
